You will receive an overview of issues that arise in first party insurance cases beginning with the sale of insurance policies, policy administration, and claims arising under policies. This presentation details the various theories of recovery including common elements, misrepresentations, nondisclosures, unfair settlement practices and other misconduct. Ms. Selden discusses rules for construing insurance policies and unfair insurance practices pursuant to Chapter 541 of the Texas Insurance Code. This presentation also includes prompt payment of claims pursuant to Sections 542.051-.061 of the “Prompt Payments of Claims Statute” with the duties that are imposed on both claimants and insurers, and the Remedies and Penalties for violations of the statute. Ms. Selden also covers recent case law of note in the various types of insurance policies including, automobile, homeowners, commercial property, life and flood insurance, as well as the Stowers Doctrine, and unfair insurance practices.
