A nuts and bolts presentation regarding the civil remedy available under the Tex. Civ. Prac. & Rem. Code 31.001 et al. for turnover and appointment of a receiver post-judgment in the aid of a civil judgment creditor against a defendant/debtor. The presentation will include teaching practice procedure (i.e. motion practice and independent proceeding options) and the form and substance of the proposed order, with discussion of things to include (and not include) in an order. The attendees will learn what types of cases are best suited for receiverships as well as what cases might be better suited for other available post-judgment remedies or bankruptcy (in particular involuntary bankruptcy). The presentation will include a discussion of the intersection of receivership (generally under state law) as compared and contrasted to bankruptcy (federal law).
