The availability of statutory damages, or damages created by statute that are available in addition to actual damages. Damages that are in addition to actual damages and can be recovered even when the plaintiff has no actual damages at all. The classic example are the treble (or triple) damages allowed under the Deceptive Trade Practices Act. How do courts and parties figure out how much should be awarded? Is it money for nothing?
